This document provides you with an overview of the relevant elements of the rights arising from the General Data Protection Regulation ("GDPR") in relation to the personal data that CornerJob, as Data Controller, processes about you.
In particular, except in certain cases, data subjects may obtain free of charge from the controller:
(i) Access to their own data: This is the data subject’s right to obtain confirmation from the data controller as to whether or not personal data relating to him/her are being processed and, if so, the right of access to his/her personal data.
(ii) The rectification without undue delay of inaccurate or incomplete personal data concerning him or her.
(iii) The erasure ("the right to be forgotten") of their data, for example, where its use is unlawful (as in the case of the processing of sensitive data).
(iv) Restriction of processing in certain circumstances.
(v) For compelling legitimate reasons, data subjects may object at any time to the processing of data relating to them.
(vi) Special right to object to automated individual decisions.
(vii) The portability of data to another controller, where technically feasible and under certain circumstances.
The rights of data subjects may be restricted, but cannot be denied. This limitation may be given in specific cases (Article 23 of the GDPR), for a specific period of time and only if necessary, in order to safeguard, amongst other things:
(i) The prevention, investigation, detection and prosecution of criminal offences, as well as disciplinary proceedings and administrative investigations.
(ii) An important economic or financial interest of a Member State or of the European Union.
(iii) The protection of the data subject or the rights and freedoms of others.
(iv) National security, public security or defence of Member States.
As a data subject you have the right to access your personal data, so you can request a copy of the data we hold about you. This applies to any personal data we hold, so we will tell you what data and what categories of data we hold and, in particular:
(i) the purposes of the processing.
(ii) the categories of personal data in question.
(iii) the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular third party recipients;
(iv) if possible, the period of retention of the personal data or, if such information is not known, the criteria used to determine this period;
(v) the right of the data subject to request from the controller the rectification or erasure of personal data or the restriction of the processing of his or her personal data and to object to such processing;
(vi) the right to submit a claim to a supervisory authority.
(vii) where the personal data have not been obtained from the data subject, any available information on their origin;
(viii) the existence of automated decisions, including profiling, and meaningful information about the logic applied and the significance and expected consequences of such processing for the data subject;
(ix) the appropriate safeguards adopted by CornerJob with respect to transfers of personal data to third countries.
The data will be sent to you electronically, and there will be no charge.
We will inform you of the purposes for which the data is processed and of any other organisation with which we share the data, even if the data we hold is collected from other sources.
This refers to the correction of your personal data held by us. In particular, if you believe that the data retained is inaccurate, you may request that it be corrected without undue delay. Similarly, if the data is incomplete, you can request that it be made complete.
We are obliged to rectify incorrect and incomplete data without undue delay. However, please note that the right of rectification only applies to objective and factual data, not to subjective statements, which, by definition, cannot be objectively wrong.
This allows you to request that we erase our records or some of our records to the extent that they identify you if any of the following reasons apply:
(i) the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;
(ii) the data subject withdraws the consent on which the processing is based and the storing of the data is not based on any other legal ground;
(iii) the data subject objects to the processing and no other legitimate grounds for processing prevail, or the data subject objects to processing for direct marketing purposes;
(iv) the personal data have been unlawfully processed;
(v) the personal data must be erased in order to comply with a legal obligation of the European Union or of the Member States that applies to the data controller;
(vi) the personal data have been collected for the purpose of providing information society services to children.
This right does not apply where the processing is necessary:
(a) to exercise the right to freedom of expression and information;
(b) for the fulfilment of a legal obligation of the EU or of the Member States to which we are subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in us;
(c) if the records are required to protect public health;
(d) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, in accordance with the provisions of the GDPR, insofar as the right of erasure would make impossible or seriously impede the achievement of the purposes of such processing;
(e) to establish, assert or defend legal claims.
You may request that access to your records be restricted where any of the following reasons apply:
(i) if you are questioning the accuracy of the data in the record and we are trying to verify it;
(ii) if the processing of your data is unlawful, but you wish the record to be retained;
(iii) if we no longer need the personal data for the purposes of the processing, but you need it for the purposes of making, exercising or defending claims;
(iv) if you have objected to the processing while we verify whether CornerJob's legitimate grounds override your legitimate grounds as a data subject.
In such circumstances, the data may only be processed by CornerJob with your consent or for the establishment, exercise or defence of claims, or for the protection of the rights of another person or for reasons of substantial public interest.
You have the right to object to CornerJob processing your data if you revoke your consent to data processing.
(i) For reasons relating to your particular situation, reasons of public interest and reasons of legitimate interest, including profiling on these grounds.
(ii) For direct marketing and research purposes, including profiling.
If you object, you may request that we restrict processing while your objection is being considered.
Every data subject will have the right not to be subject to a decision based solely on the automated processing of their data, including profiling, which has legal effects concerning them or significantly affects them in a similar way. This right shall not apply if the decision:
(i) is necessary for the conclusion or performance of a contract between you and ourselves.
(ii) is authorised by EU or Member State law to which we are subject and which provides for appropriate measures to safeguard the rights and freedoms and legitimate interests of the data subject;
(iii) is based on your express consent.
This allows you to receive a copy of your personal data you have provided to us, in a structured, commonly used and machine-readable format. The purpose of this right is to empower you as a data subject and to give you greater control over your personal data.
This right shall apply under three cumulative conditions:
(i) Firstly, the personal data requested must be processed in automated form, i.e. excluding paper files, on the basis of your prior consent or on the basis of the provision of the CornerJob service to which you are a party.
(ii) Secondly, the personal data requested must relate to your data and be provided by you.
(iii) The exercise of this right may not adversely affect the rights and freedoms of others.
You can exercise your rights under the General Data Protection Regulation directly by contacting us at dpo@eurofirms.com.
We will respond to your request to exercise any of the above rights as soon as we can and within one month (30 days) of your request. If this is not possible due to the complexity or size of the request, we will let you know. In exceptional circumstances we can extend the deadline to three months or 90 days. If so, we will let you know why.
If you believe that any use of your data may infringe any of your rights, you may file a complaint at any time by opening a support ticket from our Help Centre or, alternatively, by filing a complaint with the Spanish Data Protection Agency at www.agpd.es, or the relevant national data protection agency.
